One major objection to social rights is a failure of determining which precise social and economic claims should be granted rights status. The social rights debate has grappled with this ‘indeterminacy problem’ for quite some time, and a number of proposals have emerged aimed at fixing the content of these rights. In what follows I examine three distinct approaches to fleshing out the idea of a minimum threshold: social rights as the fulfilment of basic needs, social rights as the securing (...) of a minimally decent life and social rights as a requirement of citizenship. Each of these proposals progressively expands on what the minimum threshold of social rights requires and, conversely, what obligations they generate on part of the state. I will show that none of these approaches is entirely satisfactory and suggest that the social rights debate look elsewhere to determine its content. (shrink)

Courts play a key role in deciding on public health controversies, but the legitimacy of judicial intervention remains highly controversial. In this article I suggest that we need to carefully distinguish between different reasons for persistent disagreement in the domain of public health. Adjudicating between public health controversies rooted in factual disagreements allows us to investigate more closely the epistemic capacities of the judicial process. While the critics typically point out the lack of appropriate expertise of judges—in particular with respect (...) to health and public health—we should not move too fast in inferring from this a generalized competence problem. This article offers four reasons for vindicating the importance of judicial intervention in factual disagreements: the relative independence of judges from the political establishment, the judicial commitment to evidence, the specific nature of judicial reasoning and an additional voice for the people in the policy-making process. SummaryPedigree structures of 161 uncle/niece-aunt/nephew and 4420 first cousin consanguineous marriages registered during the 19th and 20th centuries in two large and very different Spanish regions have been analysed and their genetic consequences evaluated. The frequencies of the different pedigree subtypes within each degree of relationship were quite similar in both populations despite significant heterogeneity in inbreeding patterns. The mean X-linked inbreeding coefficient for each type of cousin mating was calculated and compared to that expected for autosomal genes. The effect (...) of genealogical structure on theFx/Fradio was compared to different cultural populations worldwide. Preferentiality and avoidance of close consanguinity along with specific types of pedigrees are discussed on the basis of premarital migration and sociocultural rules still deeply rooted in certain human groups. The present paper analyses the topic of scientific discovery and the problem of the existence of a logical framework involved in such endeavour. We inquire how several non-monotonic logic frameworks and other formalisms can account for such a task. In the same vein, we analyse some key aspects of the historical and theoretical debate surrounding scientific discovery, in particular, the context of discovery and context of justification context distinction. The judiciary is a key policy actor that is involved in deciding health rights and policy by intervening in the policy process through a variety of judicial mechanisms, yet the appropriate extent of its involvement remains contentious. Taking the competence objection seriously requires understanding it as an epistemic problem about how courts assess empirical and scientific evidence in order to competently adjudicate controversial health claims. This paper examines recent advances in social epistemology to develop insights for the epistemic competence of (...) the judiciary from a system‐oriented approach. I outline three epistemic features that set the judiciary and the judicial decision‐making process apart from other types of decision‐makers in health policy: the distribution of epistemic power, the epistemic authority of a justified believer, and the principle of disinterestedness. A basic income is typically defined as an individual’s entitlement to receive a regular payment as a right, independent of other sources of income, employment or willingness to work, or living situation. In this article, we examine what it means for the state to institute a right to basic income. The normative literature on basic income has developed numerous arguments in support of basic income as an inextricable component of a just social order, but there exists little analysis about basic (...) income within a jurisprudential or philosophical rights perspective. In our view, strong reasons of either a principled or a pragmatic nature in support of instituting a basic income scheme nevertheless often fall short of ascribing to basic income a distinctive Hohfeldian rights status. This article aims to partially redress this gap by examining two sets of questions. First, what are the implications – ethical and practical – of adopting basic income as a legal right as opposed to a mere policy? Second, we also enquire whether there should be such a right: what, if anything, is the ethical foundation that warrants granting basic income a distinctive legal rights status? This article suggests that any such foundation must be grounded in comparative evaluation and discusses several comparative strategies available to basic income advocates. The aim of this article is not to offer a definite argument in favor of a legal right to basic income, but to chart several lines of argument that a rights perspective might add to the contemporary discussion. This paper focuses on an emergency basic income as a tool for avoiding financial insecurity during the time of pandemic. The authors argue that paying each resident a monthly cash amount for the duration of the crisis would serve to protect them from the economic fallout.They suggest three reasons why the EBI proposal is particularly well-suited to play an important role in a comprehensive public health response to COVID-19: it offers an immediate and agile response; it prioritizes the most vulnerable (...) in the affected population; and it promotes a solidaristic response to the pandemic crisis. The present article studies the epictetean philosophical use of some passages of the Greek and Roman history. The concepts of love-friendship (philía) and personal con- venience (sumphéron) second the philosopher to explain why happiness (eudaimonía) has not been reached by the human being in all history. All historical war or strife (pólemos), such as the Trojan, the Medics and the Peloponnesian wars, is provoked by epistemological-moral mistakes derived from the ignorance of which is the correct place to put the sumphéron; (...) such correct place is only the personal “rational capacity” ( proháiresis). This causal explanation of the incorrect and vicious human actions, of which history is full and which destroy the existent philía between nations and provoke pólemos, constitutes an authentic epictetean philosophy of history. Nevertheless, those vicious actions have a justification in a superior Cosmological level because they are pre-determined and ordered by the God-Providence. This leads us to the possibility of observing that the stoic philosophy of history, particularly the epictetean, is analogous to some modern speculative systems of history like the ones developed by Vico or Hegel. This paper proposes communities of practice (CoP) as a process to build moral resilience in healthcare settings. We introduce the starting point of moral distress that arises from ethical challenges when actions of the healthcare professional are constrained. We examine how situations such as the current COVID-19 pandemic can exponentially increase moral distress in healthcare professionals. Then, we explore how moral resilience can help cope with moral distress. We propose the term collective moral resilience to capture the shared capacity arising (...) from mutual engagement and dialogue in group settings, towards responding to individual moral distress and towards building an ethical practice environment. In the present paper we analyze the approach that sustains that history´s study is useful for the political activities improvement. Nowadays it is considered that the historian must not elaborate his works thinking to achieve an influence on the politics. Nevertheless, during the XIX century and previously, has been a different approach. Our reflection focus on two conspicuous works of the nineteenth century about the historical discipline: Historik by Johann G. Droysen and On the use and abuse of history for (...) life by Friedrich Nietzsche. This article dives on the moral role given to the study of history, as well as dives on the causes, postulated by both thinkers, that explain why history leads to a personal overcoming. For this reason, it is necessary to define and analyze the conceptual framework in which the notion of vulnerability has been developed within the scope of bioethics. Secondly, the paper analyzes some of the main philosophical approaches that I consider should be articulated in the expansion of a critical bioethics approach focused on the notion of vulnerability. To address this issue, I analyze the reflections that we find in the work of Martha Fineman, emphasizing the main relevant aspects for bioethics. BackgroundUmbilical cord banks are a central component, as umbilical cord tissue providers, in both medical treatment and scientific research with stem cells. But, whereas the creation of umbilical cord banks is seen as successful practice, it is perceived as a risky style of play by others. This article examines and discusses the ethical, medical and legal considerations that arise from the operation of umbilical cord banks in Mexico.DiscussionA number of experts have stated that the use of umbilical cord goes beyond (...) the mere utilization of human tissues for the purpose of treatment. This tissue is also used in research studies: genetic studies, studies to evaluate the effectiveness of new antibiotics, studies to identify new proteins, etc. Meanwhile, others claim that the law and other norms for the functioning of cord banks are not consistent and are poorly defined. Some of these critics point out that the confidentiality of donor information is handled differently in different places. The fact that private cord banks offer their services as "biological insurance" in order to obtain informed consent by promising the parents that the tissue that will be stored insures the health of their child in the future raises the issue of whether the consent is freely given or given under coercion. Another consideration that must be made in relation to privately owned cord banks has to do with the ownership of the stored umbilical cord.SummaryConflicts between moral principles and economic interests (non-moral principles) cause dilemmas in the clinical practice of umbilical cord blood storage and use especially in privately owned banks. This article presents a reflection and some of the guidelines that must be followed by umbilical cord banks in order to deal with these conflicts. This reflection is based on the fundamental notions of ethics and public health and seeks to be a contribution towards the improvement of umbilical cord banks' performance. (shrink)

The influence of age and formal education on the development of moral reasoning in a Spanish sample of students was assessed by using a Spanish translation of Rest's Defining Issues Test. Our results support the hypothesis that moral development is highly related to both variables in our cultural context, although more so with formal education than with age.

El presente trabajo de tesis se centra en el estoicismo, en la obra titulada Disertaciones que recoge las enseñanzas de Epicteto pero que fue recopilada por Arriano. Es en tal texto en el que principalmente basamos la presente tesis. Analizamos las enseñanzas de Epicteto, filósofo nacido en Hierópolis (Frigia) hacia el 55 d.C., que fue un liberto que se adentró en el estoicismo tras asistir a las clases del filósofo Musonio Rufo; gracias al permiso de su amo Epafrodito pudo asistir (...) a las pláticas de tal erudito. Los dos temas a tratar, el poder y el amor, que forman parte de la ética y de la filosofía política –estoicas-, así como de la epistemología, la física y la metafísica, por ser el sistema estoico uno que está estrecha y racionalmente interconectado, han sido abordados por investigadores recientes desde distintos ámbitos y perspectivas. El poder y el amor son conceptos que deben de ser explicados y analizados a partir de los conceptos mencionados de “sentimiento”, “inclinación”, “pasión”, “bueno”, “malo”, además de los de “virtud”, “vicio”, “indiferente”, “oikéiosis”, “deber”, “sabio”, “libertad”, etc. Por lo que ambas categorías han sido abordadas desde su vinculación con, o a partir de su explicación a través de, uno o varios de los conceptos mencionados. Introduction Hospital delirium is a frequent, serious, costly, and underrecognized acute disorder of attention and cognition. Therefore, the prevention of hospital delirium is not only desirable for patients, caregivers, healthcare professionals, and the health system itself, but also a moral duty. Objective To identify and synthetize the main ethical aspects that arise related to the prevention of hospital delirium in patients 65 years and older. Methods A scoping review was carried out in Embase, Medline, and Web of Science. Articles published (...) in English or Spanish analyzing any pharmacologic, non-pharmacologic, or multicomponent intervention for prevention of delirium in hospitalized patients aged 65 years and over were included. Results Twenty-seven studies were included. Based on the frequency of appearance and the relevance, our findings were organized into three main areas. The first one was related to the principle of nonmaleficence and collected findings about the iatrogenic causes of hospital delirium and the use of restraints systems. The second area analyzed the impact of delirium in patients, families, and healthcare professionals from a relational ethics perspective, and addressed the family presence as a factor to prevent delirium. Finally, the third area is related to the quality of care. Conclusion Prevention of delirium in hospitals is essential to avoid the discomfort and potential clinical complications of patients, as well as the suffering of their relatives, caregivers, and healthcare professionals. Policymakers and healthcare managers are encouraged to make the required efforts to prevent delirium in hospitalized older patients. (shrink)

Lo que este estudio muestra es fruto de un contacto directo, a través de cuestionarios, con lo que los españoles piensan, con lo que ellos dicen que está bien o que está mal. No se trata, pues, de lo que ellos hacen ni si lo que hacen se corresponde con lo que dicen. Se trata de establecer en qué medida su percepción moral, sus juicios sobre lo que está bien o lo que está mal, depende de cómo son y de (...) las creencias y actitudes que tienen. El objetivo es poder llegar a determinar si hay tendencias generales que puedan detectarse cuando se cumplen ciertos supuestos que son la base de la psicología del desarrollo moral, y sirven a su vez para conseguir objetivos educativos. Para ello, se hace un seguimiento de factores asociados a la permisividad moral: el contexto social, la edad, el sexo y la religiosidad de los sujetos, en dos etapas muy relevantes para España: el posconcilio Vaticano II y la transición a la democracia. En ese momento de cambio profundo, se trata de saber qué prácticas entienden aceptables y cuales rechazables, cuáles admitidas y cuáles prohibidas. Por su actualidad, se destacan tres puntos: Primero, los jóvenes españoles consideran la violencia como la conducta menos permitida. Segundo, ¿por qué los jóvenes de 21-24 años son más permisivos con la violencia doméstica que sus compañeros más jóvenes de 18-20 años y de 15-17 años? Tercero, ¿por qué todos los grupos aquí encuestados justifican que una mujer decida tener un hijo sin pareja estable? (shrink)

Uno de los problemas planteados en la historia desarrollada de los protagonistas de La ciudad y los perros (1963), del escritor peruano Mario Vargas Llosa, es la presencia de una formación familiar mal constituida (padres agresivos, distanciamiento de cualquiera de ellos, favoritismo materno hacia el hijo, etc.). Esta base retrógrada provocó una limitación para cada uno de ellos: sus conductas no son corregidas, tienen comportamientos rebeldes o inhibidos, se sienten incapaces de afrontar la realidad con responsabilidad y terminan incluyéndose en (...) el mecanismo dinámico de la violencia, ya sea como víctima o victimario. Para ello, se recurrirá al análisis literario, para abordar las conductas vinculadas con los personajes que poseen rasgos de violencia en su representación. Principalmente, las propuestas teóricas de Jacques Lacan, Slavoj Žižek y Mijaíl Bajtín revelan qué se entiende en la actualidad por practicar el bien en nuestra sociedad. In order to improve the management of copyright in the Internet, known as Digital Rights Management, there is the need for a shared language for copyright representation. Current approaches are based on purely syntactic solutions, i.e. a grammar that defines a rights expression language. These languages are difficult to put into practise due to the lack of explicit semantics that facilitate its implementation. Moreover, they are simple from the legal point of view because they are intended just to model the (...) usage licenses granted by content providers to end-users. Thus, they ignore the copyright framework that lies behind and the whole value chain from creators to end-users. Our proposal is to use a semantic approach based on semantic web ontologies. We detail the development of a copyright ontology in order to put this approach into practice. It models the copyright core concepts for creation, rights and the basic kinds of actions that operate on content. Altogether, it allows building a copyright framework for the complete value chain. The set of actions operating on content are our smaller building blocks in order to cope with the complexity of copyright value chains and statements and, at the same time, guarantee a high level of interoperability and evolvability. The resulting copyright modelling framework is flexible and complete enough to model many copyright scenarios, not just those related to the economic exploitation of content. The ontology also includes moral rights, so it is possible to model this kind of situations as it is shown in the included example model for a withdrawal scenario. Finally, the ontology design and the selection of tools result in a straightforward implementation. Description Logic reasoners are used for license checking and retrieval. Rights are modelled as classes of actions, action patterns are modelled also as classes and the same is done for concrete actions. Then, to check if some right or license grants an action is reduced to check for class subsumption, which is a direct functionality of these reasoners. (shrink)

Background:The acquisition of experience is a major concern for nurses in intensive care units. Although the emotional component of the clinical practice of these nurses has been widely studied, greater examination is required to determine how this component influences their learning and practical experience.Objective:To discover the relationships between emotion, memory and learning and the impacts on nursing clinical practice.Research design:This is a qualitative phenomenological study. The data were collected from open, in-depth interviews. A total of 22 intensive care unit nurses (...) participated in this research between January 2012 and December 2014.Ethical considerations:The School of Nursing Ethics Committee approved the study, which complied with ethical principles and required informed consent.Findings:We found a clear relationship between emotion, memory and the acquisition of experience. This relationship grouped three dimensions: (1) satisfaction, to relieve the patient’s pain or discomfort, give confidence and a sense of security to the patient, enable the presence of family members into the intensive care unit and provide family members with a realistic view of the patient’s situation; (2) error experience, which nurses feel when a patient dies, when they fail to accompany a patient in his or her decision to abandon the struggle to live or when they fail to lend support to the patient’s family; and (3) the feel bad–feel good paradox, which occurs when a mistake in the patient’s care or handling of his or her family is repaired.Conclusion:Emotion is a capacity that impacts on nurses’ experience and influences improvements in clinical practice. Recalling stories of satisfaction helps to reinforce good practice, while recalling stories of errors helps to identify difficulties in the profession and recognise new forms of action. The articulation of emotional competencies may support the development of nursing ethics in the intensive care unit to protect and defend their patients and improve their relationships with families in order to maximise the potential for patient care.
